Terms of Service

These terms and conditions apply to all cakes designed, booked, and purchased from Essence Cakes. After a contract is signed or a deposit is made, clients are agreeing to these terms and conditions.

ORDERS


Orders are confirmed only upon receipt of payment.

We do not accept any changes to orders the week that the order is due.

Cancellations are not accepted on orders due within a week, and Essence Cakes reserves the right to refuse refund of any payment or deposit made on the order.

In the event of a cancellation, you must contact us in writing no later than one week before the scheduled pickup/delivery date. No cash refunds. Credit will be given toward another cake order placed within 3 months of the cancellation only. Otherwise, any deposits/payments made on the cancelled order is forfeited.

If for any reason an event for which you made a partial cake payment was cancelled, and we were not notified in writing as stated above, and the cake was not picked up or delivery was denied, you are still responsible for full payment on the order.

CAKE PICKUP


Responsibility to refrigerate and preserve any and all items becomes that of the Customer once the item has been delivered, or picked up by you or your designate.

You or your designate is responsible for handling the cake with care in transit to ensure that it arrives safely at your destination in the state is was picked up from us.

We highly recommend that you treat your CAKE PICKUP as an EXPRESS ERRAND and place the cake in a refrigerator as quickly as you can. Heat and Humidity have a negative effect on cakes and their decorations.

Place cake on a flat surface and drive with care - no sudden stops, taking corners at high speed, etc.

After the cake is picked up from our shop, responsibility for the cake becomes yours or that of your designate.



INGREDIENTS


Our ingredients include flour, sugar, eggs, butter, milk, and fruits. Although we do not use nuts in our baking, some of our products may contain nuts. We advise those with nut allergies to refrain from consuming our products.



LIABILITY


Essence Cakes is excited about the opportunity to provide excellent goods to our customers, but certain liabilities are out of the control of Essence Cakes. Once any perishable item has been delivered to the Customer, it is no longer in the control of Essence Cakes, and Customer acknowledges that responsibility to refrigerate and preserve any and all items becomes the sole responsibility of Customer once the item has been delivered to, or picked up, by the Customer. The customer, therefore, waives any and all liability claims against Essence Cakes for any liability arising from a failure to properly preserve and maintain any perishable food item after the item has been delivered to Customer by Essence Cakes, or picked up by the Customer.


In the event that there is a delay, damage, or failure to deliver because of circumstances beyond the control of Essence Cakes such as, but not limited to, sudden illness, fire, accident, weather, power failure, etc., under no circumstances shall Essence Cakes be liable to the Customer for any loss or damage (direct, indirect, punitive, actual, consequential, incidental, special, exemplary or otherwise) in excess of the total monies received in connection with the Customer's order.
